PAN-Aadhaar linkage mandatory for filing I-T returns for AY 2019-20: SC

The court's direction came on an appeal filed by the Centre against a Delhi High Court order allowing two persons to file ITR for 2018-19 without linking their Aadhaar and PAN numbers.

Linking Aadhaar with the Permanent Account Number (PAN) will be mandatory for filing Income Tax Return for the assessment year 2019-20, the apex court has clarified in a ruling. With this, the court has turned the order given by the Delhi High Court early last year.
“For the assessment year 2019-20, the Income Tax Return shall be filed in terms of the judgment passed by this Court,” a Bench comprising Justice AK Sikri and Justice S Abdul Nazeer ruled in Special Leave Petition (Civil) involving Union of India as petitioner and Shreya Sen & ANR as respondent. This means if PAN is not linked with Aadhaar, the tax return will not be accepted. The Central Board of Direct Taxes (CBDT) has extended the date to link PAN with Aadhaar till March 31, 2019.

The government had filed an SLP (Civil) in the apex court against the decision by the Delhi High Court last February. The court had permitted the respondents herein to file the Income Tax Return for the Assessment Year 2018-19 without linking of their Aadhaar and PAN numbers and it was also directed that the Income Tax Department would not insist on producing their number of Aadhaar enrolment. The aforesaid order was passed by the High Court having regard to the fact that the matter was pending consideration in this court.

Practical difficulty
According to the apex court Bench, thereafter, the Court has decided the matter and upheld the vires of section 139AA of the Income Tax Act. “In view thereof, linkage of PAN with Aadhaar is mandatory,” it said. In so far as assessment year 2018-19 is concerned, the Bench noted the point raised by the counsel appearing for the respondents that the respondents had filed the income tax returns in terms of the orders of the High Court and the assessment has also been complete. Keeping the practical difficulty in mind, the Bench gave its order for returns to be filed for the assessment year 2019-20.

The apex court, in its ruling on Aadhaar last September, made it clear that an individual has to furnish his/her Aadhaar number or the enrolment ID while filing Income Tax returns. It has also made Aadhaar-PAN card linking mandatory as well as the requirement of Aadhaar when applying for PAN card. The new order has been giving taking cognizance of September ruling.

Penalty for late filing
It may be noted that details of income, saving etc. for the financial year ending March 31, 2019 must be given in the income tax return for the assessment year 2019-20. For the assessment year 2019-20, salaried individual and individuals (non-audit) cases are required to file the return by July 31, 2019 while for audit cases including corporate it will be September 30, 2019. There is penalty provision for late filing. For example, penalty of ₹5,000 will be levied if returns are filed after July 31 but before or on December 31. This will increase to ₹10,000 if returns are filed after December but on or before March 31 next year. The penalty amount will be ₹1,000 in case of income less than ₹5 lakh.

One station was for gardening and we could plant seeds and check them every day to see how much they had grown. Another station in that classroom that sticks out in my mind is the arts and crafts station. There was a large array of crayons, markers, scissors, construction paper and building materials we could use to make pretty decorations to give to our parents for our homes. By choosing which station we wanted to work at, we were becoming much more interested in what we were learning because we were doing what we wanted to do, not what we had to do. The principle of compulsory voting was first used in Canton, a Canton of Switzerland, with expansion, for which in 1835, Canton arranged for a penal offense by the legislators for non-participants in the district council elections. This arrangement has helped Swiss citizens to experience the responsibility of the franchise. Also, due to this arrangement, the workload of political organizations has also been lighter for voters to get them out of the house to be included in the poll. Similarly in Bavaria in 1881, Bulgaria adopted 1882 AD and Belgium adopted the 1893 EC mandatory voting system. According to the arrangement of Bavaria, if more than one-third of the total number of voters does not participate in the voting, then the absentees will have to bear the entire expenditure for re-election. Belgian has imposed three penalties for absent voters, under-finance penalties, public repudiations and franchise abductions.

Booth Level Officer; A Representative of Election Commission at the Grass-Root Level

For enhanced participation of electors in the electoral process and reducing the electoral malpractices, it is essential to improve the quality of electoral registration process and of the electoral rolls. Booth Level Officer (BLO) is a local Government/Semi-Government official, familiar with the local electors and generally a voter in the same polling area who assists in updating the roll using his local knowledge. In fact, BLO is a representative of Election Commission of India (ECI) at the grass-root level who plays a pivotal role in the process of roll revision and collecting actual field information with regard to the roll corresponding to the polling area assigned to him.

Under Section 13B (2) of Representation of People Act, 1950, BLOs are appointed from amongst the officers of the Govt. /Semi Govt. /Local Bodies. Generally, one BLO is responsible for one part of the electoral roll. From August, 2006 the Commission has decided to introduce the concept of appointing BLOs who would be accountable for ensuring the fidelity of electoral roll.+

The ECI introduced this new system of appointing BLOs creating a clear line of accountability for preparation of an error-free electoral roll, making the BLOs its custodian at the polling booth level. Previously, voter-identification slips used to be distributed by the contesting candidates of various political parties and that gave scope for complaints. The preparation of accurate electoral rolls and direct distribution of voter identification slip by the BLOs also boosted voter confidence in the credibility of the election process.

BLO assists eligible citizens to become voters and obtain voter card. BLO provides those different forms for addition, deletion and correction of Electoral Roll entries, carries out physical verification, and gives his/her report to Electoral Registration Officer (ERO) .The BLO interacts with local people/ political parties’ representatives and identifies dead/shifted/duplicate voters to be removed from the electoral roll after due process of law. Another station in that classroom that sticks out in my mind is the arts and crafts station. There was a large array of crayons, markers, scissors, construction paper and building materials we could use to make pretty decorations to give to our parents for our homes. By choosing which station we wanted to work at, we were becoming much more interested in what we were learning because we were doing what we wanted to do, not what we had to do. By setting high standards for a student, the teacher is encouraging the student to do the same and will eventually...

Facebook has fined calling Windows Phone a quote. According to a Microsoft official, some windows will not support Facebook, Messenger, Instagram support from April 30, 2019. Facebook's decision states that Facebook windows are ready to stop supporting the phone. It is important that according to a report, Facebook has uploaded data of 54 million users to a third party company's server. This data contains information about the profile of the users.

Approximately half of this vulnerable population are children.

Searching for potable water sources is a daily chore for over 2 billion women and children across the globe, who spend many hours each day hauling water from pumps and basins to their homes. In what is sometimes described as a "six hour journey," this population, predominantly girls, spend their day fetching water instead

of attending school or playing with siblings or friends.

In addition, children who are consistently exposed to hazardous, unpotable water or exposed to pumps or water sources that have been contaminated by water-borne bacteria, contract diseases such as cholera and they are often affected by life-threatening diarrhea from parasites in unclean water.

Not only does the work of transporting water inhibit a child's ability to access education, but it is also "back-breaking" work. With endless household chores such as caring for livestock, siblings, washing, cooking, cleaning and storing, the need for obtaining water never ends, from morning to night, every day. The heavy water, fetched in containers that vary in size, is carried on a child's head for many miles, and with children carrying an average of one gallon or more, this water plus the container can weigh up to 10 pounds or more, which can also cause physical damage to a child's body. The older the child, the more water they typically carry, with adolescent girls and women carrying up to 45 pounds of water (roughly the weight of a kindergartner) on their head.
